Supreme Court Refuses To Cancel NEET-UG 2024, Says There's No Material To Show Systemic Breach

 



The Supreme Court on Tuesday (July 23) refused to cancel the NEET-UG 2024 exam on the ground of paper leak and malpractices. The Court stated that there was no material to indicate that the leak was systemic affecting the sanctity of the entire exam.

The Court also stated that ordering a re-examination will lead to serious consequences affecting over 23 lakh students and will lead to disruption of the academic schedule, causing a cascading effect in the coming years.

While acknowledging that there was a paper leak in the centres in Hazaribag(Jharkhand) and Patna(Bihar), the Court said that sufficient material is absent on the record to lead to the conclusion that the results of the exam stand vitiated in its entirety or that there was a systemic breach in the sanctity of the exam.

The data produced on record is not indicative of the systemic leak of the question paper which would lead to the destruction of the sanctity of the exam, the Court stated.

A bench comprising Chief Justice of India DY Chandrachud, Justices JB Pardiwala and Manoj Misra passed the order in a batch of petitions seeking to cancel the National Eligibility-cum-Entrance Test(NEET) held for Under Graduate (UG) medical admissions on May 5, 2024 for paper leak and malpractices. The results were declared on June 4.

The bench was told that the 50th percentile represents the cut-off for qualification. The examinations consists of 180 questions, each carrying four marks, making a total of 720 marks. One negative mark is assigned for wrong answers.

The 50th percentile has worked out to 164 marks out of 720. All candidates who have attained at least a threshold of 164 marks are thus qualified for being considered for admission.

The petitioners argued that the leak was systemic in nature and coupled with the structural deficiencies in the modalities of the exam, the only course of action permissible, in view of the precedents laid down by the Court in Tanvi Sarwal v. CBSE (2015), is to direct a re-test.

The Union and the National Testing Agency took the stand that the leak was localised in nature and that the beneficiaries are identifiable. The Union also cited a data analytics report prepared by the IIT-Madras which showed no abnormalities in the results or indication of any mass malpractice.

The Court pronounced the judgment today evening after hearing the matter for nearly four days.

Conclusions of the Court:

The fact that a leak of the NEET-UG 2024 paper took place at Hazaribagh and at Patna is not in dispute.

Following the transfer of the investigation, CBI has filed its status reports. The disclosures by the CBI indicate that the investigation is continuing, however, it has indicated that the present material showed that about 155 students drawn from exam centres at Hazaribagh and Patna appeared to be beneficiaries of the scam.

Since the investigation by the CBI has not attained finality, the Court required the Union Govt to indicate if any abnormalities could be inferred from the results in 571 cities. The Union has produced a report of IIT Madras. The Court has independently scrutinized the data submitted by the NTA.

At the present stage, there is absence of material on the record sufficient to lead to the conclusion that the result of the exam stands vitiated or that there is a systemic breach in the sanctity of the exam.

The data produced on record is not indicative of the systemic leak of the question paper which would lead to the destruction of the sanctity of the exam.

The Court is also mindful of the fact that directing a fresh NEET-UG test for the present year would be replete with serious consequences for over 2 million students, including in particular - (1) disruption of the admission schedule, (2) cascading effects on the course of medical education, (3) prejudicial impact on the availability of qualified medical professionals in future, (4) serious element of disadvantage to the marginalised groups of students for whom reservations have been made in the allocation of seats.

The Court is guided by the well-settled test of the possibility of segregating the tainted from the untainted. Moreover, it is important to clarify that if the investigation reveals the involvement of an increased number of beneficiaries, action will be taken against them

MCC is in receipt of requests from MDS candidates for resignation of Round-1

Urgent Attention: MCC is in receipt of requests from MDS candidates for resignation of Round-1 seats allotted to them through MCC since they have been allotted seats from Round-1 of state counselling also. Hence, the competent authority has allowed Resignation from Round-1 MDS seats allotted through MCC so that such candidates can join their state counselling seats. The Resignation facility will be available from today i.e 20.07.2024 (Saturday) from 03:00 P.M upto 06:00 P.M of 22.07.2024 i.e Monday in an online mode. Candidates will have to visit the allotted college to vacate their allotted seats and Institutes should ensure that all resignations are entered in intramcc portal of MCC failing which the resignation will be treated as ‘Null & Void’. 

NEET-UG 2024 Supreme Court Hearing Live Updates: Next Hearing on July 22, NTA to Publish Result Of All Students

 NEET-UG 2024 Supreme Court Hearing Live Updates: The Supreme Court heard a batch of pleas in connection with the NEET-UG 2024 paper leak case today, July 18. A bench comprising Chief Justice D Y Chandrachud, Justices J B Pardiwala, and Manoj Misra is hearing the matter. As many as 131 students are asking for a retest, while 254 are opposed, according to the Solicitor General. The CJI has sought information from the NTA on the number of students who changed exam cities and who made it to the top 1.08 lakh and whether there is a bias in favour of those who registered on April 9 and 10, in light of the allegations of mark inflation and paper leaks. The Supreme Court has directed NTA to announce the marks of all NEET UG 2024 students by Saturday, July 20. The next hearing has been scheduled for Monday, July 22. The SC has stated that the marks of the students be disclosed with ‘dummy roll numbers in a sequence centre-wise’ to protect the identity of the students.

NEET UG 2024: Counselling Across Four Rounds To Begin In July 3rd Week

 

The hearing of petitions for alleged paper leaks in NEET UG 2024 is currently pending in the Supreme Court. A bench, headed by Chief Justice of India DY Chandrachud, will hear the petitions on July 18. After the decision, NEET UG counselling will take place in the third week of July. The central government has given this information in an affidavit filed with the Supreme Court along with the report of IIT Madras on the NEET result. The government has said that if any candidate is found involved in any kind of fraud, his candidature will be cancelled.

Regarding the NEET UG counselling process, the central government has said that students will be allowed to change seats as per the preferences chosen in the first and second rounds. Counselling will be held in a total of four rounds. In such a situation, if seats are cancelled before the third round, it will not have any effect on the overall counselling and seat allotment. The detailed schedule of NEET UG counselling will be uploaded on the Medical Counselling Committee website at mcc.nic.in.


The third round of NEET UG counselling 2024 is expected to begin in September. “If one’s candidature is cancelled after the third round, vacant seats can still be offered in subsequent rounds. However, candidates who have already been allocated seats in earlier rounds will not be able to participate in subsequent rounds,” the government has said, as reported by the Times of India.

On the other hand, if any candidature is cancelled after the fourth and final round, the vacant seats will be filled through an additional round based on the approval of the Supreme Court.

The petitions related to NEET UG will be heard in the Supreme Court on July 18. The matter is being heard by a bench headed by Chief Justice of India DY Chandrachud. The bench said on Thursday that the Center and NTA have filed their affidavits in compliance with the court’s order of July 8. The lawyers of some petitioners have not yet received the affidavits. Given this, the hearing of the case has been postponed to July 18.
